La incorporación de la perspectiva de género en Derecho internacional privado es difícil, por su carácter técnico y abstracto. Las autoridades que aplican estas normas intentan corregir las distorsiones generadas por la ausencia de enfoque de género en esta disciplina a través de correctivos como el orden público internacional, para alcanzar la justicia del caso concreto y proteger derechos fundamentales. Pero, estas correcciones son insuficientes para aplicar la perspectiva de género, porque no remueven los obstáculos que están en el origen (...) de la discriminación de la mujer. La ausencia de perspectiva de género en estas normas es una forma de violencia institucional, que habilita la incorporación en el ordenamiento jurídico de normas que, pretendiendo defender la libertad de la mujer, conducen a normalizar su subordiscriminación. Es precisa una revolución del Derecho internacional privado, que vaya más allá de los efectos inmediatos de las normas reguladoras de las relaciones privadas internacionales. (shrink)

ABSTRACT Various mechanisms to ensure the protection of subjects in human research have been suggested, including the presence of witnesses during the informed consent process. For our commentary on the use of witnesses and their potential role and responsibility during the consent process, we start by addressing current guidelines for human subjects research in four Latin American countries. By using examples from public health research, we highlight some of the practical difficulties of using witnessed consent, from becoming a meaningless ritual (...) at one end of the spectrum to the research subject feeling intimidated or coerced to participate at the other. Apart from these practical difficulties, it is unclear what responsibility the witness could and should have. We argue that there are important ethical questions about the role of witnesses that have not been adequately addressed in national and international regulations. This work addresses these gaps and argues that more debate is required to define the role and responsibilities of witnesses in the consent process, their training requirements and whether a universal legal requirement for witnessed consent, regardless of the type of research, is desirable. The purpose of this paper is to identify the factors that affect the intention to use Big Data Applications in companies. Research into Big Data usage intention and adoption is scarce and much less from the perspective of the use of these techniques in companies. That is why this research focuses on analyzing the adoption of Big Data Applications by companies. Further to a review of the literature, it is proposed to use a UTAUT model as a starting model with (...) the update and incorporation of other variables such as resistance to use and perceived risk, and then to perform a neural network to predict this adoption. With respect to this non-parametric technique, we found that the multilayer perceptron model for the use of Big Data Applications in companies obtains higher AUC values, and a better confusion matrix. This paper is a pioneering study using this hybrid methodology on the intention to use Big Data Applications. The result of this research has important implications for the theory and practice of adopting Big Data Applications. (shrink)

Psychological flexibility is a key concept of acceptation and commitment therapy. This factor has been linked with psychological wellbeing and associated factors, such as quality of life, in cancer patients. These and other positive results of acceptation and commitment therapy in cancer patients found in previous research could be enhanced by using mhealth tools. A three-arm randomized superiority clinical trial, with a pre-post-follow-up repeated measures intergroup design with a 1:1:1 allocation ratio is proposed. A hundred and twenty cancer patients will (...) be randomly assigned to one of the following interventions: face-to-face ACT + mobile application, face-to-face ACT, and Waitlist control group. The primary expected outcome is to observe significant improvements in psychological flexibility acceptance and action questionnaire- II in the face-to-face ACT + app group, after comparing baseline and post-treatment scores, and the scores will remain stable in the two assessment points, 3 and 6 months after the intervention. Secondary expected outcomes are significant increasing scores in quality of life and post-traumatic-growth, and significant decreasing scores in anxiety and depression, insomnia and fatigue at the same assessment points. Also, it is expected that the scores of this group will be higher than the scores of the face-to-face ACT group and the waitlist control group. This study aims to assess the efficacy of a combined intervention for psychological flexibility and associated symptoms in cancer patients. The results of this protocol may help to consider the use of acceptation and commitment therapy and mhealth applications in cancer settings as a valid therapeutic choice.Clinical Trial Registration[www.ClinicalTrials.gov], identifier [NCT05126823]. Lara Buchak sets out a new account of rational decision-making in the face of risk. She argues that the orthodox view is too narrow, and suggests an alternative, more permissive theory: one that allows individuals to pay attention to the worst-case or best-case scenario, and vindicates the ordinary decision-maker.

En este libro, la autora desarrolla su concepción del juicio reflexionante inspirada en Emmanuel Kant y en Hannah Arendt para concentrarse en cómo cierto tipo de narraciones modelan nuestras nociones de lo que consideramos moral. Lara nos ofrece distintas concepciones sobre el mal en su formulación histórica mediante los ejemplos de las tragedias griegas, las diferentes concepciones sobre el mal en la obra de Shakespeare, el uso literario de la metáfora en la obra de Joseph Conrad y en narraciones (...) fílmicas que describen la crueldad humana. Lara sugiere que el aprendizaje moral es un proceso en el que intervienen las instituciones sociales, la voluntad de los individuos y de las sociedades para comprometerse a un debate abierto y con ello modelar los juicios colectivos sobre el pasado. Lara enfatiza que el juicio reflexionante se da entre un evento, una narración de dicho evento y la recepción pública de dicha narrativa. En este libro se aportan importantes métodos para la comprensión del fenómeno moral del mal, porque introducen nuevas verdades desvelatorias acerca de eventos particulares que no pueden ser simplemente captados por medio de categorías conceptuales. Lara utiliza como fuentes a Jürgen Habermas, Walter Benjamin, Primo Levi, Giorgio Agamben y Ariel Dorfman para probar la conclusión de este tipo de narraciones: la acción (de crueldad) ata de manera definitiva al perpetrador con su víctima. There has been little investigation of male adolescent violence against women as acknowledged by boys themselves, and even less on such violence in different contexts with comparative studies of behavior between those who perpetrate this violence and the population at large. This study used cluster analysis to establish a male adolescent typology based on boys’ self-reporting of violence against women in three contexts. The participants were 3,132 Spanish teenage boys aged 14–18 with experience of relationships with girls. Three discrete, identifiable (...) types were obtained: the first group, of non-violent boys; the second group, more involved in sexual harassment online outside a relationship but with a low incidence of dating violence offline; the third group, with abuse in the three contexts but less involved in sexual harassment online than the second group. The logistic regression analysis showed that justification of male dominance and violence was the main risk condition for inclusion in the second and third groups, followed by low self-esteem and risky sexual behaviors online. The findings based on these results are important for preventing male adolescent dating violence against women in the three male types detected. (shrink)

This paper is concerned with the role of self-observation in managing complexity in meaning systems. Revising Niklas Luhmann's theory of mass media, we approach the mass media system as a social sub-system functionally specialized in the coupling of psychic systems' self-observation and social systems' self-observation.According to Autopoietic Systems Theory and von Foerster's second order cybernetics, self-observation presupposes a capability for meta-observation that demands a specific distinction between observer and actor. This distinction seems especially relevant in those social contexts where a (...) separation between the action of observation and other social actions is required. However, in those social contexts where the defining action is precisely observation, the border between observer and actor is blurred.We shall consider the significant divergence between the implicit and the explicit epistemologies of the mass media system, which appears to be characterized by the explicit assumption of a classic objectivist epistemology, on one side, and a relativist epistemology on the other, posing a hybrid epistemic status somewhere in between science and arts. There are currently two robust traditions in philosophy dealing with doxastic attitudes: the tradition that is concerned primarily with all-or-nothing belief, and the tradition that is concerned primarily with degree of belief or credence. This paper concerns the relationship between belief and credence for a rational agent, and is directed at those who may have hoped that the notion of belief can either be reduced to credence or eliminated altogether when characterizing the norms governing ideally rational agents. It presents a (...) puzzle which lends support to two theses. First, that there is no formal reduction of a rational agent’s beliefs to her credences, because belief and credence are each responsive to different features of a body of evidence. Second, that if our traditional understanding of our practices of holding each other responsible is correct, then belief has a distinctive role to play, even for ideally rational agents, that cannot be played by credence. The question of which avenues remain for the credence-only theorist is considered. (shrink)

Tied as we are to a masculine representation and language it becomes necessary to take it out of the Oedipal world and logic, to read it in keys that bring it closer to the central yet invisible figure of Yocasta. In Kant scholarship the significance of the beauty of nature for Kant’s aesthetics has been traditionally favored over the beauty of art. By focusing on Kant’s characterization of genius as a gift of nature, my aim is to show that, in contrast to the already existing interpretations of this issue in Kant literature, the works of art as the works of genius can indeed serve as ‘signs’ that nature and the world as a whole is hospitable to the realization of (...) our moral ends, or is morally purposive. My claim that for Kant not only the beauty of nature but also the works of art as the works of genius serve as signs of world’s moral purposiveness, or of—in Dieter Henrich’s words—the “moral image of the world,” calls for a reevaluation of the role of art in Kant’s moral teleology and, consequently, for a reevaluation of the place of art in Kant’s aesthetics. This paper provides an account of what it is to have faith in a proposition p, in both religious and mundane contexts. It is argued that faith in p doesn’t require adopting a degree of belief that isn’t supported by one’s evidence but rather it requires terminating one’s search for further evidence and acting on the supposition that p. It is then shown, by responding to a formal result due to I.J. Good, that doing so can be rational in a (...) number of circumstances. If expected utility theory is the correct account of practical rationality, then having faith can be both epistemically and practically rational if the costs associated with gathering further evidence or postponing the decision are high. If a more permissive framework is adopted, then having faith can be rational even when there are no costs associated with gathering further evidence. (shrink)

In the peer disagreement debate, three intuitively attractive claims seem to conflict: there is disagreement among peers on many important matters; peer disagreement is a serious challenge to one’s own opinion; and yet one should be able to maintain one’s opinion on important matters. I show that contrary to initial appearances, we can accept all three of these claims. Disagreement significantly shifts the balance of the evidence; but with respect to certain kinds of claims, one should nonetheless retain one’s beliefs. (...) This paper investigates the nature and foundation of duties to oneself in Kant’s moral theory. Duties to oneself embody the requirement of the formula of humanity that agents respect rational nature in them‐selves as well as in others. So understood, duties to oneself are not subject to the sorts of conceptual objections often raised against duties to oneself; nor do these duties support objections that Kant’s moral theory is overly demanding or produces agents who are preoccupied with their own virtue. Many view cancellation as a method for holding influential personalities accountable for bad behavior, while others think cancelling amounts to censorship and bullying. I hold that neither of these accounts are worth pursuing, especially if the aim is social progress. In this paper, I offer a situated account of cancellation and cancel culture, locating the phenomenon in our exclusionary history while examining the social dynamics of belief. When we situate cancel culture, we can see how problematic instances of cancelling are (...) embedded in ignorance. While combatting ignorance appears to call for a remedy rooted in feminist standpoint epistemology, there are risks in adopting naive practices of deference. Applying criticisms of epistemic injustice and adopting Táíwò’s elite capture framework, I explain how well-intentioned cancelling can work against social movements. Since epistemic trust mechanisms discourage self-reflection and belief revision, the relevant tactics for enacting social change—coalition politics and education—seem out of reach. I conclude by sketching cancel culture as a diagnostic tool: cancellation can be used appropriately in marginalized communities, but when it comes to combatting ignorance among privileged folks, we should view cancel culture as a method for determining where our social institutions are failing us. The ‘rollback argument,’ pioneered by Peter van Inwagen, purports to show that indeterminism in any form is incompatible with free will. The argument has two major premises: the first claims that certain facts about chances obtain in a certain kind of hypothetical situation, and the second that these facts entail that some actual act is not free. Since the publication of the rollback argument, the second claim has been vehemently debated, but everyone seems to have taken the first claim for (...) granted. Nevertheless, the first claim is totally unjustified. Even if we accept the second claim, therefore, the argument gives us no reason to think that free will and indeterminism are incompatible. Furthermore, seeing where the rollback argument goes wrong illuminates how a certain kind of incompatibilist, the ‘chance-incompatibilist,’ ought to think about free will and chance, and points to a possibility for free will that has remained largely unexplored. One phenomenon arising in epistemic life is allegiance to, and break from, a tradition. This phenomenon has three central features. First, individuals who adhere to a tradition seem to respond dogmatically to evidence against their tradition. Second, individuals from different traditions appear to see the same evidence differently. And third, conversion from one tradition to another appears to be different in kind from ordinary belief shift. This paper uses recent work on the nature and rationality of faith to show that (...) these features can all emerge from individuals acting rationally—in particular, from individuals rationally having faith in the core assumptions of their traditions. One upshot is that we don't need to employ the idea of incommensurability to explain these features. (shrink)

It is sometimes said that faith is recalcitrant in the face of new evidence, but it is puzzling how such recalcitrance could be rational or laudable. I explain this aspect of faith and why faith is not only rational, but in addition serves an important purpose in human life. Because faith requires maintaining a commitment to act on the claim one has faith in, even in the face of counter-evidence, faith allows us to carry out long-term, risky projects that we (...) might otherwise abandon. Faith is a central attitude in Christian religious practice. The problem of faith and reason is the problem of reconciling religious faith with the standards for our belief-forming practices in general (‘ordinary epistemic standards’). In order to see whether and when faith can be reconciled with ordinary epistemic standards, we first need to know what faith is. This chapter examines and catalogues views of propositional faith: faith that p. It is concerned with the epistemology of such faith: what cognitive attitudes (...) does such faith require, what epistemic norms govern these attitudes, and whether Christian faith can ever adhere to them. In “Can it be rational to have faith?”, it was argued that to have faith in some proposition consists, roughly speaking, in stopping one’s search for evidence and committing to act on that proposition without further evidence. That paper also outlined when and why stopping the search for evidence and acting is rationally required. Because the framework of that paper was that of formal decision theory, it primarily considered the relationship between faith and degrees of belief, rather than between faith (...) and belief full stop. This paper explores the relationship between rational faith and justified belief, by considering four prominent proposals about the relationship between belief and degrees of belief, and by examining what follows about faith and belief according to each of these proposals. It is argued that we cannot reach consensus concerning the relationship between faith and belief at present because of the more general epistemological lack of consensus over how belief relates to rationality: in particular, over how belief relates to the degrees of belief it is rational to have given one’s evidence. Decision theory has at its core a set of mathematical theorems that connect rational preferences to functions with certain structural properties. The components of these theorems, as well as their bearing on questions surrounding rationality, can be interpreted in a variety of ways. Philosophy’s current interest in decision theory represents a convergence of two very different lines of thought, one concerned with the question of how one ought to act, and the other concerned with the question of what action consists (...) in and what it reveals about the actor’s mental states. As a result, the theory has come to have two different uses in philosophy, which we might call the normative use and the interpretive use. It also has a related use that is largely within the domain of psychology, the descriptive use. This essay examines the historical development of decision theory and its uses; the relationship between the norm of decision theory and the notion of rationality; and the interdependence of the uses of decision theory. A lo largo del siglo XIX mexicano, la definición de las relaciones entre la Iglesia y el Estado estuvo siempre en la mesa de la discusión pública. Desde la independencia y hasta el movimiento de Reforma, se trató de delimitar el papel que la institución eclesiástica debía ocupar en la nueva nación. Así, a mediados de siglo se reconfiguró en respuesta la secularización que se produjo en México y en gran parte del mundo occidental.

Individual differences in convergent and divergent thinking may uniquely explain variation in analogical reasoning ability. Across two studies we investigated the relative influences of divergent and convergent thinking as predictors of verbal analogy performance. Performance on both convergent thinking and divergent thinking uniquely predicted performance on both analogy selection and analogical generation tasks. Moreover, convergent and divergent thinking were predictive above and beyond creative behaviours in Study 1 and a composite measure of crystallised intelligence in Study 2. Verbal analogies in (...) Study 2 also varied in semantic distance, with results demonstrating divergent thinking as a stronger predictor of analogy generation for semantically far than for semantically near analogies. Suppose we want to do the most good we can with a particular sum of money, but we cannot be certain of the consequences of different ways of making use of it. This article explores how our attitudes towards risk and ambiguity bear on what we should do. It shows that risk-avoidance and ambiguity-aversion can each provide good reason to divide our money between various charitable organizations rather than to give it all to the most promising one. It also shows (...) how different attitudes towards risk and ambiguity affect whether we should give to an organization which does a small amount of good for certain or to one which does a large amount of good with some small or unknown probability. Hernán Cortés, the conquistador of Mexico, conquered Mesoamerican territories between 1519 and 1525. Over the course of those years he maintained an intense epistolary exchange with the Emperor Charles V, to whom he wrote his Cartas de relación and many other letters and memories. In return, the emperor rewarded Cortés with vassals, titles and honors. However, as time passed, when Cortés established his home in the New Spain, the epistolary exchange, which was so fruitful at the beginning, in the end (...) became a nuisance for Charles V because of the constant complaints of the conquistador. As a consequence, between 1530 and 1547, after the glorious years, the relationship between Cortés and the monarch became estranged and complicated. This paper analyzes some of the letters Cortés sent to the emperor, and reflects on the importance of his figure in 16th century Spain, as well as the relevance of a relationship, that of the emperor and the conquistador, that changed the face of the known world. Hernán Cortés, el conquistador de México, llevó a cabo sus conquistas entre 1519 y 1525. En esos años mantuvo una intensa relación epistolar con el emperador Carlos V, a quien dirigió sus Cartas de relación y muchas otras cartas y memoriales. A su vez, el emperador premió a Cortés con vasallos, títulos y honores. Sin embargo, al pasar de los años, cuando Cortés se estableció en la Nueva España, esa relación epistolar, que al principio fue muy fructífera, al final se (...) convirtió en una molestia por las continuas quejas y reclamos del conquistador. Así, entre 1530 y 1547, después de los años de gloria, la relación entre Cortés y el monarca se tornó lejana y complicada. En este trabajo se analizan algunas de las cartas que Hernán Cortés envió al emperador y se hace una reflexión sobre la importancia de su figura en la España del siglo XVI, así como la relevancia de una relación, la del emperador y el conquistador, que cambió la faz del mundo entonces conocido. Notable examples of macaronics, the insertion of foreign vocabulary into poetry, are attributed to the well-known eighth-century poet, Abū Nuwās, who experimented with mixing Persian in his Arabic poetry but whose motivation remains unclear. This article looks at a selection of his and other macaronic verses ranging from the seventh to tenth centuries and argues that Persian was inserted deliberately as a marker of a Persian identity, standing for the “foreign Other.” Far from being a sign of a pro-Persian shuʿūbī (...) sentiment, the employment of Persian only reinforces the established hierarchy of the two identities in that period. By the tenth century, however, this hierarchy is cleverly flipped on its head in a macaronic poem by the popular Iraqi poet, Ibn al-Ḥajjāj. While many of the examples are comic and even obscene in character, this article shows that the employment of Persian in Arabic poetry was a deliberate practice with serious and meaningful implications.
